CAN-SPAM! Thank you, ma'am!

It seems that different people have different interpretations of the Controlling the Assault of Non-Solicited Pornography And Marketing Act of 2003.

I suspect that the US Federal Trade Commission interprets it as a way of controlling unsolicited pornography and marketing email. Ajay Singh, on the other hand, appears to take the acronym at face value: CAN-SPAM is an open invitation to do just that.

He offers me Business Leads, but he's really only selling a database likely scraped in the same way he scraped my email address. I have no idea what he means by having clearly mentioned the source mail-id of this mail, the only thing that comes close to an ID is the Message-ID in the headers. And that's hardly in the spirit of mentioning clearly.

But what really makes this stand out as spam is that my address is not in the To field. It, along with lord knows how many others, is in the BCC field. Furthermore, the originating domain name and email address are not the same as the business that he represents in his signature. And that's a contravention of the Act:

Don’t use false or misleading header information. Your “From,” “To,” “Reply-To,” and routing information – including the originating domain name and email address – must be accurate and identify the person or business who initiated the message.

So, too, is not giving full information on his location:

Tell recipients where you’re located. Your message must include your valid physical postal address. This can be your current street address, a post office box you’ve registered with the U.S. Postal Service, or a private mailbox you’ve registered with a commercial mail receiving agency established under Postal Service regulations.

Admitting that he's from India is not enough to be in compliance. The guidance is easy enough to find, so why lie? (confused)

Could it be that Ajay's not a straight-up guy? (thinking)
